New inter-State application brought by the Netherlands against Russia concerning downing of Malaysia Airlines flight MH17

The Government of the Netherlands has lodged an application with the European Court of Human Rights against the Russian Federation. It relates to the downing on 17 July 2014 of flight MH17 over the territory of Eastern Ukraine. There are currently five other inter-State applications and approximately 7,000 individual applications pending before the Court concerning the events in Crimea and Eastern Ukraine.

Among the individual applications are the cases Ayley and Others v. Russia (application no. 25714/16) and Angline and Others v. Russia (no. 56328/18) lodged by relatives of people who were killed in the MH17 disaster.

On 10 July 2020 the Government of the Netherlands lodged an inter-State application under Article 33 (Inter-State cases) of the European Convention on Human Rights against the Russian Federation. The inter-State application has been registered under no. 28525/20. The application concerns the shooting down of Malaysia Airlines Flight MH17 over Eastern Ukraine on 17 July 2014, killing 298 persons, including 196 Dutch nationals. According to the Government of the Netherlands, the plane was shot down from a BUK-TELAR surface-to-air missile system which belonged to and was provided by the Russian Federation. The Government of the Netherlands allege that the Russian Government were responsible for the deaths, in breach of Articles 2 (right to life), 3 (prohibition of prohibition of torture and inhuman or degrading treatment) and 13 (right to an effective remedy) of the European Convention on Human Rights.

The Russian Federation has repeatedly denied any involvement in the destruction of the aircraft.
